General provisions

• Elegant Tour S.L. (hereinafter: “We”, “Administrator”, “Intermediary”) operates the website accessible at eleganttours.pl, which allows Customers to book tourist services: optional excursions, attractions and vehicle rentals through partner Cicar.
• We act exclusively as a tourist intermediary. We are not the organiser of package travel within the meaning of Directive (EU) 2015/2302 and do not provide combined or package services.
• The booking contract is concluded directly between the Customer and the final service provider. Our role is limited to correctly transmitting the booking and data.

Definitions

• Customer – natural person (consumer) or entity making a booking through the Website.
• Service – optional excursion/attraction organised by Elegant Tour S.L. or a Cicar vehicle booking.
• Booking confirmation / Voucher – an email containing the booking number, details and participation ticket.
• Force majeure – extraordinary events beyond the parties' control (general strikes, government decisions, natural disasters, officially declared pandemics, airspace closures, etc.).

Contract conclusion and execution

• Bookings are made by filling in the form on the website and clicking the “Book” or “Send message” button.
• A contract with Elegant Tour S.L. is concluded when the Customer receives the Booking confirmation/voucher and the payment is recorded (full amount or deposit as stated in the offer).
• The Customer must provide truthful information. Providing false data or attempting fraud entitles us to cancel the booking without refund of administrative costs.

Payments

• Available payment methods: credit/debit card via Redsys, bank transfer (account details in the Booking confirmation), and Paygold by individual agreement.
• The Customer has 72 hours (3 calendar days) from the time of booking to make full payment for the Service. This period runs from the moment Elegant Tour S.L. sends the Booking confirmation / voucher.
• Failure to pay within 72 hours results in automatic cancellation of the booking without further notice.

Cancellations, withdrawal and changes

• Cancellations must be made in writing to: reservas@eleganttours.es.
• Standard cancellation conditions (may vary for specific routes): ≥ 48 hours — 0% (full refund); 48–24 hours — 50% of the Service price; < 24 hours or no-show — 100% of the Service price.
• In case of force majeure preventing the Service → full refund within 14 days (after deduction of any properly documented fixed costs).
• The 14-day right of withdrawal for distance contracts does not apply if the Service must begin before the end of that period (consumer law exception).
• Changes by the Customer to the date or program are possible only with our consent and, if applicable, after payment of any price difference.
• We reserve the right to modify the program for safety or adverse weather conditions; if a point of the itinerary is unavailable we will provide an attractive alternative.
• Cancellation by us (e.g., insufficient group size, unsafe weather) → full refund or an alternative service of comparable value within 14 days.

Claims and liability

• Complaints regarding the course of the excursion (quality, programme, transport, guide) should be submitted in writing within 30 days of the Service date.
• Complaints will be processed within 30 calendar days.
• Elegant Tour S.L. is responsible for the correct organisation and execution of the optional excursions as described in the offer.
• In case of Cicar vehicle bookings — full responsibility for the vehicle, insurance, technical condition and any damages lies exclusively with Cicar.

Final provisions

• Spanish law governs these Regulations.
• Disputes with consumers are subject to the courts competent for the seat of Elegant Tour S.L. (Arona / Santa Cruz de Tenerife) or, if more favourable for the consumer, the court of the consumer's habitual residence (Regulation Brussels I bis).
• The Regulations may be amended. The current version is always available on the Website. Changes do not affect contracts concluded prior to their introduction.
• The Regulations enter into force on 20 March 2026.
